Why doesn’t the zune xp theme need uxtheme.dll file? ?

I do not have the update uxtheme.dll file on my system so there for i can not use 3rd party themes … but how come i can use the zune xp theme ?

and if i can use that are there other themes that can be used with out the hassle of changing the uxtheme.dll file ?

Reason i why i wont change it is because i have tried once .. long story short i had to get my system reformatted …
